Tiko Mail — Terms of Service

1. Acceptance of Terms
By using Tiko Mail (“Services”), you agree to these Terms. If you do not agree, do not use the Services. You must be at least 18 years old.
If you are using Tiko Mail on behalf of an organization, you represent you have authority to bind that organization.
2. What Tiko Mail Does
Tiko Mail provides AI-powered classification, triage, drafting, automation, and productivity workflows for email systems.
The Service may analyze email content and metadata solely to provide the core functionality. For details on how we handle your data, see our How We Use Your Data page.
3. Roles: Controller vs. Processor
For email data accessed through integrations such as Gmail or Outlook:
- • You (or your organization) are the Data Controller.
- • Tundra AI Labs, Inc. acts as a Data Processor, processing your data only according to your instructions (i.e., through your use of Tiko Mail).
For account-level information (billing, authentication info, support communications), Tundra is the Data Controller.
4. User Responsibilities
You agree to:
- • Connect only accounts you are authorized to access
- • Ensure your use complies with applicable laws and your own organizational policies
- • Obtain any required consent from others (e.g., if you use features that analyze or process communications involving third parties)
- • Review all AI-generated content before sending or acting on it
- • Not use the Services to transmit harmful, illegal, or abusive content
- • Maintain security of your credentials
Tiko Mail is not designed for PHI, PCI, or other regulated sensitive data unless explicitly stated otherwise.
5. Integrations with Gmail, Outlook & Other Providers
Tiko Mail uses secure OAuth-based integrations. Your use of Gmail, Outlook/Exchange, or other providers is subject to their terms and policies. Tiko Mail does not alter or circumvent permission scopes enforced by Google, Microsoft, or other providers.
6. Use of AI & Language Model Providers
Tiko Mail uses machine-learning models and third-party AI APIs. You acknowledge:
- • AI outputs may be inaccurate, incomplete, or misleading
- • AI is probabilistic and may generate unexpected or incorrect results
- • You are solely responsible for validating all outputs
- • Tundra is not liable for decisions you make based on AI outputs
We do not use your email data to train, fine-tune, or improve our models or third-party models. Models may temporarily process data to generate outputs but do not retain it.
7. Data Handling & Subprocessors
We use vetted subprocessors (e.g., cloud hosting, authentication, AI API providers) that are contractually bound to process data only for our instructions.
We may update subprocessors from time to time. If you object to a new subprocessor within 10 business days of notice, we will work with you in good faith to resolve the objection; if not resolved, your remedy is to stop using the Services. Subprocessors may include AI inference providers such as Google Gemini, each of which processes data only for the purpose of generating requested outputs.
8. Security
We use commercially reasonable security practices:
- • Encryption in transit and at rest
- • Access-controlled infrastructure
- • Logging and monitoring
- • Segmented environments
No system is perfectly secure; you assume risk associated with internet-based services.
9. Prohibited Uses
You may not:
- • Attempt to reverse engineer, copy, or replicate Tiko Mail
- • Build or assist in building a directly competitive product using the Service
- • Interfere with or disrupt the Service
- • Use the Service for spam or unsolicited outreach
- • Use automated tools to scrape or extract data in violation of our policies
10. Intellectual Property
All software, models, prompts, workflows, designs, and content in Tiko Mail are owned by Tundra or its licensors.
You may not copy, modify, or create derivative works without written permission.
11. Service Availability, Backups & Maintenance
Tiko Mail is provided on a commercially reasonable effort basis. We may perform maintenance, scheduled or unscheduled. We maintain backup processes, but do not guarantee the recovery of any specific data. You are responsible for retaining your own backups of critical information.
12. Limitation of Liability
To the fullest extent permitted by law:
- • We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages
- • We are not liable for losses related to misclassification, missed emails, AI-generated inaccuracies, or service outages
- • Total liability for all claims shall not exceed the amount paid by you in the preceding 12 months
These limits apply regardless of legal theory.
13. No Warranties
The Services are provided “as is” and “as available.” We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Indemnification
You agree to indemnify Tundra against claims, damages, and expenses arising from:
- • Your content or data
- • Your misuse of the Services
- • Violation of these Terms
- • Your communication decisions made using AI outputs
15. Termination
We may suspend or terminate access for any violation or for misuse. You may stop using the Services at any time. Upon termination, we will delete or anonymize your data within a commercially reasonable period unless legally required to retain it. You may request data deletion at any time.
16. Assignment
You may not assign your rights under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or business transaction.
17. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (e.g., outages, natural disasters, legal restrictions, labor disputes).
18. Changes to Terms
We may update these Terms periodically. Notice will be provided through the Service or via email. Continued use constitutes acceptance.
19. Governing Law & Dispute Resolution
Governing law: State of Delaware.
Disputes will be resolved exclusively through binding arbitration under AAA rules in Delaware. Class actions are waived.
